Even if it can be proven that a criminal is in fact a "psychopath" that cannot be cured, i think it's a silly excuse to reduce their sentence for that reason. If they are in fact insane and don't understand the difference between right and wrong or what they were doing at the time, I'm sure they're not going to be that bothered about being put in prison if they're confused all the time anyway. And if their insanity cannot be cured, why would anyone think it is a plausible option to keep that person out of prison anyway?

Also, I'm not exactly sure these criminals can be certainly proclaimed a psychopath, like ShaanA said above. There are many great actors who stand trial claiming to be insane all the time. In my opinion, this is all just a big ploy to win cases.

The fact that judges are biased in favor of psychopaths with medical reasoning as to why they commited the crimes that they did, does not surprise me in the least. If you have a medical history or a neurological problem that affects your cognitive psychology you can only be held to blame for your actions to a certain degree. If a criminal has a brain tumor that affects a particular segment of their brain it can interfere with their social interactions. Judges must decipher whether the psychopath's problems can be fixed medically or if it is something that cannot be fixed by a medical procedure. If their brain "made them do it" makes the psychopath a victim as well. This would psychologically make the judge more inclined to take it easy on him or her.

This is a topic that has been seen most recently in the news in the case of the colorado gunman, who shot up a movie theater outside of Denver at the midnight showing of "The Dark Knight Rises". His lawyers are making the case that he was and is insane and his mind made him do the horrible violence. Just like this blog notes, the judge and jury might cut the "insane" guy slack because he wasnt of right mind. This is the only insane part of the whole situation, the fact that we could give someone slack just because he looks and acts crazy but inside his mind he could be playing all of us. There is no way of telling if someone is for sure crazy or not but that fact that it may be used as an excuse is troubling to me.
